Definitions used in these Terms:

  • Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
  • World Coffee Gear or WCG: World Coffee Gear B.V.
  • Product: a physical item offered or sold by World Coffee Gear.
  • Service: an agreed service supplied in connection with a purchase, including permitted customisation work.
  • Agreement: the distance contract between the Consumer and World Coffee Gear for the relevant Product or Service.

2. Applicability

  1. These Terms apply to Consumer purchases of Products and agreed Services from World Coffee Gear through www.worldcoffeegear.eu.
  2. The webshop is intended for delivery to available destinations within countries of the European Union.
  3. The Consumer must be at least 18 years old or have permission from a parent or legal guardian who accepts responsibility for the purchase.
  4. These Terms apply to agreements concluded on or after publication of this version. A previous order remains governed by the version accepted when that order was placed.
  5. Before submitting an order, the Consumer can read, print and save these Terms. World Coffee Gear will provide the order confirmation and the applicable contractual information by email or another durable medium that permits storage and unchanged future consultation.
  6. A provision in these Terms never restricts a mandatory statutory Consumer right.

3. Formation of the agreement

  1. Website content is an invitation to place an order unless expressly stated otherwise.
  2. By submitting an order, the Consumer makes an offer to purchase the selected Products or Services.
  3. An automated acknowledgement only confirms receipt of the order. The agreement is formed when World Coffee Gear sends an order confirmation or expressly starts performing the order.
  4. World Coffee Gear may reject or cancel an order where a Product is unavailable, payment or Customer information cannot be verified, fraud is suspected or performance would be unlawful. Any amount already paid for a cancelled item will be refunded.
  5. If an ordered Product becomes unavailable, World Coffee Gear may propose a suitable alternative. A substitute is only supplied after the Consumer agrees. Otherwise, the affected item is cancelled and refunded.

4. Product information and obvious errors

  1. World Coffee Gear takes reasonable care to present Products, specifications, dimensions, materials, colours, compatibility, availability and prices accurately.
  2. Display settings and photography may cause minor colour differences that do not affect the Product’s agreed characteristics.
  3. Product descriptions, confirmed specifications and statements on which a Consumer may reasonably rely form part of the agreement.
  4. An obvious pricing, calculation or typing error does not bind World Coffee Gear. If an obvious error is discovered after ordering, World Coffee Gear will contact the Consumer before dispatch. The Consumer may accept the corrected information or cancel the affected Product for a full refund.
02

Ordering and payment

5. Prices and minimum order

  1. Consumer prices are stated in euros and include VAT unless clearly indicated otherwise.
  2. The minimum Consumer order value is €75 including VAT after discounts, excluding shipping costs.
  3. The total price, including VAT, delivery and any mandatory additional charges, is displayed before the Consumer submits the order.
  4. A discounted or promotional Product retains the same statutory conformity and withdrawal rights as a full-price Product.

6. Payment

  1. Available payment methods and the applicable payment timing are displayed in checkout before the order is submitted.
  2. Depending on the Consumer’s country, eligibility, order value and the payment provider’s acceptance criteria, the available Mollie payment solutions may include immediate payment, payment in instalments or payment after delivery.
  3. The Consumer selects the preferred available payment method and expressly agrees to the payment timing connected with that method.
  4. Deferred payment or instalment services may be supplied by an external payment provider and may be subject to a lawful eligibility or credit assessment and that provider’s separate terms, which are shown before selection.
  5. World Coffee Gear does not require advance payment beyond the limit permitted by mandatory Consumer law. A Consumer may nevertheless voluntarily choose an available method involving full advance payment.
  6. World Coffee Gear does not charge a Consumer payment-method fee where such a fee is prohibited by law.
  7. World Coffee Gear may verify payment and delivery information before accepting or dispatching an order.

7. Coupons and promotions

  1. A coupon, voucher or promotion is valid only during the stated period and subject to any stated Product, account or minimum-purchase requirements.
  2. Unless expressly stated otherwise, one code may be used per order, codes cannot be combined and a code cannot be applied retrospectively.
  3. A promotional code provided without payment has no cash value and cannot be exchanged for cash.
  4. Following a valid withdrawal, the amount actually paid is refunded. Reinstatement of a promotional code depends on the stated promotion conditions and does not limit mandatory Consumer rights.
  5. World Coffee Gear may stop or correct a promotion in the event of an obvious error, misuse or fraud, without affecting agreements already validly concluded.
03

Delivery and risk

8. Delivery area, time and shipping costs

  1. World Coffee Gear delivers to available delivery destinations within the European Union.
  2. Delivery normally takes approximately 3–7 working days, depending on stock, destination and carrier performance. A different delivery period may be shown or agreed for a specific order.
  3. Unless another delivery time has been agreed, Products will be delivered without undue delay and no later than 30 days after the agreement is concluded.
  4. Free standard shipping applies to Consumer orders of at least €75 including VAT after discounts to the Netherlands, Belgium and Luxembourg.
  5. For other available EU destinations, excluding Cyprus and Malta, free standard shipping applies from €299.00 including VAT after discounts.
  6. Shipping to Cyprus and Malta is always charged, regardless of the order value. The applicable shipping charge is shown in checkout before payment. For other destinations, shipping charges below the applicable free-shipping threshold are also shown in checkout before payment.

9. Late, partial or failed delivery

  1. If delivery is late, the Consumer may give World Coffee Gear a reasonable additional period to deliver. If delivery still does not take place, the Consumer may terminate the affected agreement and receive a refund.
  2. No additional period is required where World Coffee Gear refuses delivery or an agreed essential delivery date is missed.
  3. World Coffee Gear may make a reasonable partial delivery. The Consumer will not be charged an additional shipping cost solely because World Coffee Gear divided the shipment.
  4. The Consumer must provide an accurate and accessible delivery address. Additional reasonable delivery costs caused by incorrect information or an unjustified refusal to accept delivery may be charged where permitted by law.

10. Transfer of risk and delivery problems

  1. The risk of loss or damage remains with World Coffee Gear until the Consumer, or a third party appointed by the Consumer other than the carrier, physically receives the Product.
  2. This does not apply where the Consumer independently appoints a carrier that was not offered by World Coffee Gear.
  3. The Consumer is requested to inspect the parcel and Products promptly after delivery. Visible transport damage, breakage, scratches, dents, an incorrect item, a shortage or a missing accessory or component should preferably be recorded on the carrier’s delivery document and reported to World Coffee Gear within 48 hours after delivery. The report should be sent to hello@worldcoffeegear.eu and include the order number and, where possible, clear photographs of the shipping packaging, shipping label and affected Product.
  4. Reporting visible delivery damage within 48 hours enables World Coffee Gear to investigate the matter promptly with the carrier. Failure to report within this period does not automatically exclude or limit the Consumer’s mandatory statutory rights. A later report will be assessed under applicable consumer law and on the available evidence.
  5. A technical defect or other lack of conformity that could not reasonably have been discovered upon delivery must be reported within a reasonable time after it becomes apparent. Such defects remain subject to the Consumer’s statutory conformity rights and the applicable commercial warranty.
04

Withdrawal and returns

11. Right of withdrawal

  1. The Consumer may withdraw from an eligible online purchase without giving a reason within 14 days after the day on which the Consumer, or a designated third party other than the carrier, receives the Product.
  2. For multiple Products delivered separately, the period starts after receipt of the last Product or final part of the order.
  3. The Consumer may exercise this right through the permanent online withdrawal function, the model withdrawal form or any other clear statement sent to hello@worldcoffeegear.eu.
  4. The withdrawal is on time if the statement is sent before the 14-day period expires.
  5. World Coffee Gear will confirm receipt of an electronic withdrawal request without undue delay.
  6. If World Coffee Gear has not provided the legally required information about the right of withdrawal, the withdrawal period is extended in accordance with mandatory law.

12. Returning Products after withdrawal

  1. The Consumer must return the Product no later than 14 days after notifying World Coffee Gear of the withdrawal.
  2. Returns must be sent to: World Coffee Gear Returns, Grote Ohéweg 3, 6081 PT Haelen, The Netherlands.
  3. The Consumer bears the direct return-shipping cost following a change of mind, unless World Coffee Gear has agreed to bear that cost.
  4. The Consumer may inspect and handle a Product as would reasonably be permitted in a physical shop.
  5. The Consumer is responsible only for diminished value caused by handling beyond what is necessary to establish the Product’s nature, characteristics and functioning.
  6. Original packaging should be used where reasonably possible to protect the Product, but its absence does not by itself remove the statutory right of withdrawal.

13. Exceptions to withdrawal

The statutory right of withdrawal does not apply where an applicable legal exception exists, including:

  • Products made to the Consumer’s specifications or clearly personalised, including Products personalised by laser engraving or imprinting;
  • Products that deteriorate or expire rapidly;
  • sealed Products that are not suitable for return for health-protection or hygiene reasons where the seal has been broken after delivery; and
  • other exclusions expressly provided by applicable mandatory law.

Personalised Products cannot normally be returned because the Consumer changes their mind. This does not affect the Consumer’s rights if a personalised Product is defective, damaged or does not match the approved artwork or specification.

14. Refunds after withdrawal

  1. World Coffee Gear will refund all payments received for the returned Products, including the cost of the least expensive standard outbound delivery offered for the order.
  2. If only part of an order is returned, the original delivery cost is not refunded where that cost would also have applied to the Products retained.
  3. Additional cost resulting from the Consumer choosing a more expensive delivery method than standard delivery is not refunded.
  4. The refund will be made without undue delay and no later than 14 days after World Coffee Gear receives the withdrawal notice.
  5. World Coffee Gear may withhold the refund until it receives the Products or proof that they have been sent back, whichever occurs first.
  6. The original payment method will be used unless the Consumer expressly agrees otherwise and incurs no additional cost.
05

Guarantee and complaints

15. Statutory conformity and legal guarantee

  1. The Consumer is always entitled to a Product that conforms to the agreement and has the quality, safety, durability and functionality that may reasonably be expected.
  2. World Coffee Gear, as the seller, remains responsible for these statutory conformity rights. The Consumer is not required to pursue the manufacturer first.
  3. If a Product does not conform, the Consumer may be entitled to free repair or replacement and, where the legal conditions are met, an appropriate price reduction or termination and refund.
  4. The duration of statutory conformity rights is determined by applicable law and the Product’s reasonably expected lifetime. It is not limited by a manufacturer’s or commercial warranty period.

16. Additional commercial warranty

  1. In addition to statutory rights, the standard commercial warranty supplied through World Coffee Gear is one year.
  2. Fellow and Planetary Design Products have a two-year commercial warranty.
  3. The applicable commercial warranty period starts on delivery.
  4. The commercial warranty covers defects in materials or workmanship and does not cover normal wear and tear, accidental damage, misuse, improper maintenance, unauthorised repair or modification, or use contrary to the Product instructions.
  5. The commercial warranty never replaces, shortens or limits the Consumer’s statutory conformity rights.

17. Reporting a defect or complaint

  1. A Consumer who purchased the Product directly from World Coffee Gear may report delivery damage, a defect, a warranty request or an approved return or exchange through the World Coffee Gear Consumer Return & Warranty Form or by email to hello@worldcoffeegear.eu.
  2. A Consumer who purchased the Product from an independent reseller must contact that reseller first. The reseller is the Consumer’s contractual seller and is responsible for handling the Consumer’s request. This World Coffee Gear Consumer form is not intended for purchases made from a reseller.
  3. The form in this article is not the withdrawal form. A Consumer wishing to cancel an eligible online purchase within the 14-day withdrawal period should use the online withdrawal function described in article 11.
  4. Please include the order number, a clear description and, where useful, photographs or video.
  5. World Coffee Gear may reasonably request an opportunity to inspect the Product and will provide return instructions where a return is needed.
  6. The reasonable return cost of a covered defective Product is borne by World Coffee Gear.
  7. World Coffee Gear will acknowledge a complaint and aims to provide a substantive response within 14 days. If more time is reasonably required, the Consumer will be informed.

18. Liability

  1. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for intent or deliberate recklessness, death or personal injury caused by negligence, mandatory product liability and mandatory Consumer rights.
  2. Subject to mandatory law, World Coffee Gear is not liable for losses that were not reasonably foreseeable when the agreement was concluded or that arise from using a Product for a business purpose.
  3. The Consumer must take reasonable steps to prevent or limit further damage after discovering a problem.
06

Website use and final terms

19. Website use, intellectual property and external links

  1. The website, its design, text, photographs, videos, logos, graphics and other original content are protected by intellectual-property rights owned by World Coffee Gear or its licensors.
  2. Content may be viewed and printed for personal, non-commercial use. It may not be copied, adapted, republished, distributed or commercially used without the relevant rights owner’s permission.
  3. Product and brand names belonging to third parties remain the property of their respective owners.
  4. The website may contain links to independent third-party websites. World Coffee Gear does not control those websites and is not responsible for their availability, content or separate terms.
  5. The Consumer must not misuse the website, attempt unauthorised access, transmit malicious code, disrupt its operation or use it unlawfully.
  6. World Coffee Gear may restrict access where reasonably necessary for security, maintenance, fraud prevention or serious misuse.

20. Artwork supplied for customisation

  1. A Consumer supplying a logo, image, text or other artwork for customisation confirms that they own the necessary rights or have permission to use and reproduce it for the requested Product.
  2. World Coffee Gear may refuse artwork that appears unlawful, infringes third-party rights or cannot be produced safely or to an acceptable technical standard.
  3. The Consumer remains responsible for checking and approving spelling, positioning and artwork shown in the final proof before production.
  4. World Coffee Gear uses supplied artwork only as necessary to assess, produce and administer the customisation order, subject to the Privacy Policy.

21. Privacy and cookies

Personal data is processed in accordance with the Privacy Policy. Information about cookies and similar technologies is available in the Cookie Policy.

22. Force majeure

  1. World Coffee Gear is not responsible for delay caused by circumstances beyond its reasonable control, such as serious carrier disruption, fire, extreme weather, government measures, strikes, cyber incidents, utility failures, epidemics, war or supplier disruption.
  2. This does not remove the Consumer’s mandatory rights regarding late or failed delivery, termination and refund.

23. Changes and severability

  1. World Coffee Gear may update these Terms for future agreements. Updated Terms do not retrospectively change an order already concluded.
  2. If a provision is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision is replaced only to the extent permitted by law.
  3. Failure to enforce a provision once does not constitute a waiver of the right to enforce it later.

24. Applicable law and jurisdiction

  1. These Terms and the agreement are governed by Dutch law.
  2. The Consumer remains entitled to mandatory protection granted by the law that would apply without this choice, including mandatory protection in the Consumer’s EU country of habitual residence where applicable.
  3. The Consumer may bring proceedings before a court competent under applicable EU and national jurisdiction rules, including where applicable the courts of the Consumer’s place of residence.

Important: these Terms do not restrict rights that cannot legally be excluded. Where these Terms conflict with mandatory Consumer law, the mandatory legal right applies.
